User's access to and use of the Junior's Fresh Inc. website (the "Site") is subject to the following Terms and Conditions and all applicable laws, which by accessing the Site, means User has accepted these Terms and Conditions without limitation or qualification. As a condition of User's use of this Site User warrants and agrees that it will not use this Site for any unlawful purpose.

INDEMNIFICATION
User agrees to indemnify, defend, and hold Junior's Fresh Inc. and its subsidiaries, affiliates, officers, directors, agents, co-branders or other partners, employees, and representatives harmless from and against any and all claims, damages, losses, costs or expenses (including reasonable attorneys fees and disbursements) which arise directly or indirectly out of or from User's (i) breach of this Agreement, (ii) access or use of the Site and/or the Services. This Section shall survive in the event this Agreement is terminated for any reason.

RETURN POLICY
All sales are considered final as our products are perishable and cannot be restocked.  All requests and inquiries as to returns should be emailed to support@juniorsfresh.com and will be considered on a case-by-case basis.

SEVERABILITY
These Terms and Conditions shall be governed by and construed and enforced in accordance with the laws of the State of New York. If any provisions of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable.

NO WAIVER
A failure on the part of Junior's Fresh Inc. to enforce any part of this agreement shall not constitute a waiver of any  of  Ju nior's Fresh Inc. rights under this agreement, whether for past or future actions on the part of any person. Only a specific written waiver signed by an authorized representative of Junior's Fresh Inc. shall have legal effect.
